The Peshawar High Court made a decision about PTI‘s internal election and symbol case. Justice Arshad Ali wrote a 26-page decision. The court focused on two questions: if the case belongs in the Peshawar High Court and if the Election Commission can decide on intra-party elections.
The decision stated that since the elections happened in Khyber Pakhtunkhwa and the Election Commission is there too, according to Section 209 of the Election Act, the Election Commission doesn’t have the authority. However, based on the decisions of the Supreme Court, Islamabad High Court, and Peshawar High Court, the last two have the authority to hear the case.
The court emphasized that creating a political party is a fundamental right for every Pakistani citizen. Political parties should have a supportive environment and the right to compete in elections with their chosen symbol.
The decision declared that denying the constitutional right to an election symbol is illegal. Therefore, the Election Commission’s decision is invalid, and PTI deserves the election symbol. PTI’s certificate should be posted on the website.
The court mentioned that a more detailed judgment with additional explanations will be released later.
