The Supreme Court, led by Chief Justice Qazi Faiz Isa and a 7-member bench, recently made a decision regarding Article 62-1F. They overturned the lifelong disqualification, and the announcement will be made live from courtroom number one.
Justice Qazi Faiz Isa expressed satisfaction with a 5-year disqualification period for public officials. He emphasized that parliamentary decisions should be respected, and the Constitution doesn’t mandate a lifelong disqualification. Chief Justice argued that disqualification for life goes against Islamic principles.
The court discussed the absence of a specified period in the law and questioned why, if the parliament didn’t mention a duration, the disqualification should be lifelong. Justice Mansoor highlighted that if the law prescribes a 5-year disqualification, a lifelong penalty seems contradictory.
The Attorney General asserted that the Supreme Court misinterpreted the constitution in the case of lifelong disqualification.
