Imran Khan, the former Prime Minister, has seen his aspirations to participate in the elections shattered.

The Supreme Court of Pakistan dismissed the request for an immediate hearing on the petition to suspend the Tosha Khana decision against Imran Khan, citing the unavailability of a bench.

In a Supreme Court hearing on Imran Khan’s application to suspend the Tosha Khana decision, the PTI lawyer urged the court for an expedited consideration of the request. Acting Chief Justice Sardar Tariq Masood explained that, as per the High Court’s decision on the Toshakhana case, a three-member bench is required, but such a bench is not available this week. Lawyer Shehbaz Khosa emphasized the national significance of the case, stating that if relief is granted in the Tosha Khana matter before December 30, Imran Khan could participate in elections.

Justice Athar Minullah pointed out that there is no precedent for suspending the entire decision when the sentence is suspended, despite instances of it happening before. Addressing the lawyer, Justice Athar Minullah advised against delving into the merits of the case, explaining that it can only be heard by a three-member bench, which is currently unavailable in Islamabad due to judges’ unavailability. Even if the High Court’s decision is suspended now, it would serve no purpose. Consequently, the request for an immediate hearing on the suspension of the Tosha Khana decision was declined due to the unavailability of the bench.

Meanwhile, the Supreme Court has indicated its intention to hear PTI’s contempt of court plea tomorrow concerning the issue of ensuring a level playing field in the elections. The Acting Chief Justice suggested that the contempt petition could be filed tomorrow.

The court instructed PTI lawyers to formally submit an application for withdrawing the appeal from the legal team. The court stated that the application has not been officially received yet and advised the submission of an application. It was mentioned that an inquiry would be conducted on the administrative side, involving the SP.
