In Islamabad, the Special Official Secrets Act Court, while delivering its judgment in the trial for cipher case, has declared that the security report from SP Adiala Jail will be disclosed during the trial within the prison, and the proceedings will be conducted openly.
The hearing for the cipher case is currently underway in the judicial complex of Islamabad, presided over by Judge Abul Hasnat Zulqarnain. Present in the court are the attorneys representing the Chairman of PTI, FIA special prosecutors, as well as Imran Khan’s sisters and Shah Mahmood’s daughter.
At the outset of the hearing, lawyer Safi Salman Safdar informed the court that today is scheduled for the hearing of the cipher case, emphasizing that the case had not been expedited previously.
Meanwhile, Judge Abul Hasnat instructed the court staff to present the case records. In the course of the hearing, jail authorities submitted a report regarding the appearance of the PTI chairman in court. The judge reviewed the report, stating that according to the jail authorities, they are unable to produce Imran Khan due to security reasons. Additional security has been requested from Islamabad Police, citing serious security concerns for the PTI Chairman.
The Superintendent of Adiala Jail sent a letter to the court, read by FIA Special Prosecutor Shah Khawar, explaining the security issues. The lawyer Safai objected to the letter, asserting that there had been no terrorist incident in Islamabad, and Chairman PTI should be present in court. Safdar accused the Superintendent of Adiala Jail of acting against the Islamabad High Court’s decision.
In response, the judge directed the court to read the first page of the letter, as the subsequent pages were marked as confidential. Imran Khan’s lawyer questioned the limitations imposed on his client, expressing concern about not being able to go to jail or court.
The judge assured that a proper decision would be made, emphasizing the court’s interest in an open trial for the Cipher case. He mentioned that he had ordered the appearance of Chairman PTI and Shah Mahmood in court, regardless of security concerns, for an open trial in accordance with section 352.
Despite objections and requests from Imran Khan’s lawyer for his appearance, the court reserved its decision regarding the appearance of Imran Khan and Shah Mehmood, with the pronouncement scheduled for a later time.
Approximately an hour later, the court delivered its verdict, stating that based on the security report from Superintendent Adiala Jail, the trial will take place within the jail premises and will be open. Those interested in attending the case hearing will not be restricted, and journalists will be allowed to cover the Cipher case hearing. It’s noteworthy that the Islamabad High Court had previously invalidated the jail trial of the cipher case against Imran Khan.
